Your smoke alarms can still beep when you test them and be illegal

Smoke alarms expire. NSW requires them replaced within 10 years of the date they were manufactured — not the date they went in — and that date is printed on the back of the unit, so you have to take one off the ceiling to read it. The catch is that the test button doesn’t tell you. It checks the battery and the sounder, so a ten-year-old alarm chirps happily while the part that actually detects smoke has been quietly degrading. This bites harder in Tweed Heads than most places because people here stay put: four homes in ten are owned outright, so the alarms usually went in at the last sale or renovation and nobody has looked since. If you can’t remember replacing yours, they’re due. Take one down and read the date on the back. That’s the whole check.

You’re in NSW

The rules change at the bridge, and most advice you’ll read is Queensland’s

Search anything about electrical compliance around here and you’ll mostly get Gold Coast answers, because that’s where the search traffic is. They don’t apply to you. Tweed Heads is in New South Wales, where the requirement sits in the Environmental Planning and Assessment (Development Certification and Fire Safety) Regulation 2021, Part 13, Division 2, clauses 94 to 96: alarms on every level, in hallways near bedrooms, meeting AS 3786. NSW does not mandate photoelectric alarms and does not mandate interconnection. Cross to Coolangatta and Queensland requires both, in every bedroom, phased through to 1 January 2027. So if someone quotes you a Queensland deadline for a Tweed Heads house, they’re reading the wrong state’s rules. Worth adding that Fire and Rescue NSW recommends going past the legal minimum and putting one in every bedroom anyway, which is what we’d fit either side of the border.

In NSW this is an annual job, not a deadline you can tick off once

Landlords across the border deal with one-off compliance dates. NSW puts a continuing duty on you instead, and a third of Tweed Heads is rented. You must check that the alarms are working every year, install or replace removable batteries every year, and replace the alarm itself within 10 years of manufacture. Once you know one isn’t working, you have two business days to repair or replace it. You can’t hand the duty to the tenant in the agreement, and if you don’t act inside those two business days a tenant can arrange a licensed electrician themselves and you have to reimburse them within seven days. Because it’s a rhythm rather than a date, it’s the kind of thing that slides across two or three tenancies without anyone noticing. Put it in the calendar with the annual inspection and it stops being a problem.
